Nyctra Terms of Use
Important: Nyctra provides general risk information and situational-awareness tools. It does not provide investment, legal, medical, emergency, security, or other professional advice. Verify important information with original sources and relevant authorities before taking action.
1. Agreement and provider
These Terms of Use form an agreement between you and Beijing Qijian Technology Co., Ltd. ("we", "us", or "our") regarding your download, access, and use of the Nyctra app and related services. By using Nyctra, you confirm that you have read and accepted these Terms, the Privacy Policy, and, when you purchase a subscription, the Subscription Terms.
For apps obtained through Apple, these Terms supplement the Apple Standard End User License Agreement. If a mandatory platform term conflicts with these Terms, the mandatory platform term controls to the extent of that conflict.
2. What Nyctra provides
Nyctra aggregates public and licensed information to provide risk briefs, maps, alerts, market watch features, translations, reports, and automated analysis. Available features may differ by platform, country, app version, data-source availability, and subscription status. Features not displayed in your current version are not promised or enabled.
3. Informational limits
Events, locations, severity scores, summaries, translations, forecasts, market associations, notifications, and generated analysis may be incomplete, delayed, unavailable, or inaccurate. They are provided for general information and situational awareness only. Nyctra does not replace qualified professionals, official emergency services, government agencies, exchanges, issuers, or original publishers.
You remain responsible for decisions made using the app. For emergencies or immediate threats, contact local emergency services and follow official instructions. For financial, legal, medical, travel, security, or business decisions, obtain appropriate professional advice and independently verify material facts.
4. Accounts, device data, and settings
The current version does not require a separate Nyctra account. The app may use random installation identifiers and local storage to maintain preferences, watchlists, alert rules, cached content, usage allowances, and membership status. Uninstalling the app or clearing app data may remove local records. You are responsible for protecting your device, app-store account, exported content, and any webhook or sharing destination you configure.
5. Subscriptions and purchases
Paid features are offered through the app store supported by your platform. Product availability, price, currency, tax, billing period, trial terms, renewal, cancellation, refunds, and purchase restoration are governed by the store and the terms shown at purchase. Additional details are provided in the Subscription Terms.
6. Data sources and third-party services
Nyctra may rely on app stores, notification providers, map and location services, advertising services, automated-analysis providers, public or licensed data sources, and websites opened from source links. Third-party availability, accuracy, privacy practices, fees, and restrictions are controlled by those providers. Opening an external link leaves Nyctra and may be subject to the destination's own terms and privacy policy.
7. Acceptable use
You must use Nyctra lawfully and responsibly. You must not:
- use the app to violate law, infringe rights, spread unlawful content, or facilitate harmful activity;
- misrepresent automated analysis or risk information as verified official advice;
- reverse engineer, bypass paid-feature controls, tamper with purchase verification, or interfere with app security;
- attack, overload, scrape, or automate requests in a manner that unreasonably disrupts the service or its data providers;
- submit malicious links, credentials, unlawful personal information, or content you do not have the right to process.
8. Intellectual property
Nyctra's software, interface, branding, original text, and product materials are owned by us or our licensors and are protected by applicable law. Source materials and third-party content remain subject to their respective owners' rights and attribution requirements. These Terms grant you a limited, personal, non-exclusive, non-transferable right to use the app as intended; they do not transfer ownership.
9. Availability and changes
We may update, suspend, limit, or discontinue features to address legal requirements, security, platform changes, data-source availability, abuse, maintenance, or product development. We do not guarantee uninterrupted or error-free availability. Where a material change affects an active paid service, we will handle it according to applicable law and app-store requirements.
10. Disclaimer and liability
To the maximum extent permitted by applicable law, Nyctra is provided on an "as available" basis without warranties that all information will be accurate, complete, current, or continuously available. Nothing in these Terms excludes rights or liabilities that cannot legally be excluded. Subject to those mandatory protections, we are not responsible for losses caused solely by third-party outages, inaccurate source data, delayed notifications, automated-analysis errors, unauthorized device access, or decisions made without independent verification.
11. Suspension and termination
You may stop using Nyctra at any time. We may restrict access when reasonably necessary to address unlawful use, security threats, payment fraud, interference with the service, or material breach of these Terms. Ending use or uninstalling the app does not automatically cancel an app-store subscription.
12. Updates to these Terms
We may update these Terms when features, laws, platforms, or service arrangements change. The updated date will be shown at the top of this page. When required by law, we will provide additional notice or request renewed consent.
13. Governing law and contact
These Terms are governed by the laws of the People's Republic of China, without limiting mandatory consumer protections that apply in your location. Questions may be sent to:
